Acceptance of Terms of Use
The HB Access mobile application (“App”) is available as an Android and iOS mobile application that allows you to book rides on the transit services offered by the City of Harrisonburg. The City provides the App subject to the following Terms of Use Agreement (“Agreement”). By accessing and using the App, you accept and agree to be bound by this Agreement. By installing and using the App, you are confirming that you are fully able and competent to accept and be bound by the terms of this Agreement.
No Representations, No Warranties, and No Liability
By providing the App, the City of Harrisonburg makes no representations or warranties that any information or content provided to you through the App is accurate, complete, reliable, or error-free. All services provided through the App are provided on an “as available” and “as is” basis. The City disclaims all representations, warranties, or conditions, whether expressed or implied, related to the App (including but not limited to implied warranties of merchantability and fitness for a particular purpose).
Your Risk, Responsibility, and Indemnity
You agree to comply with all applicable laws and to not engage in any illegal conduct when accessing and using the App. Your use of the App is solely at your own risk. You assume all responsibility for obtaining access to and using the App, including any third-party fees (such as internet service provider or airtime charges). To the fullest extent permitted by law, you agree to indemnify and hold the City of Harrisonburg, its officials, employees, and volunteers harmless from and against all loss, cost, expense, damage, liability, or claims arising out of your use of the App.
Restriction on and License to Access and Use
The App and its contents may not be used or reproduced without the express written consent of the City of Harrisonburg. You shall not copy, repackage, redistribute, or modify the App or its contents. The City grants you a limited, non-exclusive, non-transferable license to access and make personal use of the App for the non-commercial purpose of booking rides on the City’s transit services. Any unauthorized use of the App automatically terminates this license.
Amendments
The City of Harrisonburg reserves the right to amend this Agreement at any time. Your continued use of the App following any changes constitutes your acceptance of the new terms.
